1. Introductory Provisions

  1. These Terms and Conditions (hereinafter referred to as the “Terms”) apply to the purchase of goods via the online store www.ecugarage.cz operated by ECU Garage CZ s.r.o. (hereinafter referred to as the “Seller”).
  2. By confirming the order, the Buyer agrees to these Terms.

2. Specifics of the Goods Sold

  1. The Seller specializes in the sale of tuning and performance parts for engine and vehicle modifications.
  2. Unless expressly stated otherwise, these goods are intended exclusively for sports and racing use off public roads and may not be approved for use on public roads.
  3. Installation and use of the goods may require professional knowledge and equipment. The Seller strongly recommends that installation be carried out only by a qualified person.

3. Disclaimer of Liability

  1. The Seller is not liable for any direct or indirect damage, injury, loss, or costs incurred in connection with:
    • the installation or assembly of the goods,
    • the use of the goods,
    • incorrect wiring, adjustment, or combination with other parts.
  2. The Buyer acknowledges that the use of tuning parts may lead to increased wear or damage to the vehicle.
  3. All risks associated with the installation and use of the goods are borne by the Buyer.

4. Order and Conclusion of the Contract

  1. The Buyer may place an order through the website www.ecugarage.cz.
  2. By sending the order, the Buyer confirms that they are familiar with the specifics of the goods sold and the disclaimer of liability according to these Terms.
  3. The contract is concluded at the moment the order is confirmed by the Seller.

5. Price and Payment Terms

  1. Goods prices are stated including VAT, unless otherwise stated.
  2. The Buyer may pay the price:
    • by bank transfer to the Seller’s account,
    • cash on delivery,
    • online by payment card.

6. Delivery of Goods

  1. The risk of damage to the goods passes to the Buyer at the moment of receipt from the carrier.
  2. The Buyer is obliged to check the integrity of the packaging upon receipt of the shipment and, in the case of obvious damage, not to accept the shipment or to draw up a report with the carrier.

7. Withdrawal from the Contract (Consumer)

  1. The consumer has the right to withdraw from the contract within 14 days of receipt of the goods.
  2. The right to withdraw from the contract does not apply to goods customized according to the Buyer’s wishes, goods made to order, ECU software modifications, and other individual calibrations.

8. Complaints

  1. The warranty does not cover defects caused by:
    • improper installation,
    • vehicle modifications incompatible with the given part,
    • use in racing or extreme conditions.
  2. Complaints are handled in accordance with the Civil Code and the Consumer Protection Act.

9. Personal Data Protection

  1. The Seller processes the Buyer’s personal data in accordance with applicable legal regulations and the Privacy Policy available on the Seller’s website.

10. Final Provisions

  1. These Terms are governed by the laws of the Czech Republic.
  2. The Seller reserves the right to amend these Terms.
